Definitions
Front-End means a Microsoft Access database file which resides
on the user’s PC. It contains a few tables and all
the forms, reports, queries and code required to run The
Rainbow Diary®.
Back-End means another Microsoft Access database which contains only the tables
associated with The Rainbow Diary®.
Licence
Your fee grants you a yearly licence to use one back-end database and as many
front end databases connected to the back-end as the system will allow. You
may, should you wish, combine these two files into one stand-alone system.
You have the right to use the software as a diary system. You may not connect
the front-end to any other database.
The licence to use the database will time-out after 12 months. The diary will
not stop working - you will be able to see your existing appointments. You
will not be able to insert any new appointments.
The Rainbow Diary® Licence is not exclusive to you, other people or companies
may use the software.
You cannot re-assign the licence or sell, rent or hire it, or in any way transfer
the licence or software to someone else or any other legal entity or organisation.
You must not reverse engineer or decompile any of the code in the database.
All rights to this product, including the intellectual property in the
Rainbow Diary® remain with ACCESSible IT.
Microsoft’s rights apply to the use of the Access software and must be
honoured, respected and complied with.
The Rainbow Diary® is a registered trademark of ACCESSible IT and may not be used
without written permission.
Bugs
If there are any bugs in the software ACCESSible IT will fix them at no charge
during the first 60 days after purchase. Normally, bug fixes are emailed to
the client but should you require the fix to be sent on a CD, a small charge
for postage and handling will be levied. We will use all means possible to
provide reasonable after-sales support as long as this is commercially viable.
Statutory Rights
Your statutory rights will be honoured. We disclaim all other warranties and
conditions either express or implied.
Liability
The extent of our liability is limited to the cost of the licence.
We are not liable for direct, indirect or consequential losses nor are we liable
for lost opportunities, damage to your reputation or any other damage or cumulative
loss suffered or incurred by the malfunction of The Rainbow Diary Diary.
Back-Ups
You must ensure that back-up copies of the data are taken at regular intervals.
Taking an off-site back-up copy of the database once a day (or more often)
is the best way to ensure that the diary is always available. You may keep
back-up copies of the data in one or more Access files which represent different
years or some other arbitrary division on the data.
Virus and Firewall Protection
Computers using The Rainbow Diary® should be firewall and virus protected.
Service Updates
Service packs and upgrades to Microsoft Office and Microsoft operating systems
should be applied as soon as they are issued.
Data-Protection
Where the system holds personal information about a living individual it is
the duty of the Data Controller to ensure that the laws concerning Data Protection
are obeyed.
Interpretation
This agreement will be interpreted in accordance with the laws of England
